Ignition Interlock Program

Ignition interlock devices must be installed on any vehicle operated by anyone who has been convicted of certain alcohol-related offenses. These offenders will  be notified by mail of the mandatory ignition interlock requirement once the information is entered on their driving record. Offenders should make sure they have updated their mailing address with WYDOT Driver Services so they will receive notification in a timely fashion. 

Following are some of the offenses and the required ignition interlock time periods:

Driving Under the Influence (alcohol involved)

  • 1st DUI with blood-alcohol content of .15 percent or greater - six months 
  • 2nd DUI - one year 
  • 3rd DUI - two years 
  • 4th or subsequent DUI - lifetime (may appeal after five years) 

Refusal

  • 1st offense - six months from date of offense
  • 2nd offense - one year from date of offense
  • 3rd offense - two years from date of offense
  • 4th or subsequent offense - lifetime (may appeal after five years) from date of offense

NOTE:  

Second or subsequent refusals are considered to constitute a conviction; therefore, the mandatory ignition interlock time period may be longer than that stated above.  

The suspension or revocation time period associated with an alcohol-related offense, or refusal, may be longer than the requirement to have the ignition interlock device. If an offender chooses to remove the device prior to the end of their suspension or revocation period, their driving privileges will again be withdrawn until the suspension or revocation period ends, all re-licensing requirements are met, and another $50 reinstatement fee is paid.

Offenders are required to:

  1. File SR-22 insurance with the department;
  2. Pay the $50 reinstatement fee;
  3. Have an approved ignition interlock device installed on their car and maintain it; and
  4. Apply for a special "IIR" restricted driver's license.

Once the "IIR" restricted license is issued, any vehicle an offender operates must be equipped with an approved ignition interlock device for the mandatory period required by law. Circumventing or disconnecting the device will result in additional legal action and driving penalties.

Ignition Interlock - Alcohol-Related Offenses prior to July 1, 2009

  Ignition Interlock Law: (Effective July 1, 2006) 

If you only have an alcohol-related offense committed prior to July 1, 2009, this part of the law pertains to you.

Any person whose driver’s license has been suspended or revoked for a second or subsequent conviction of DUI or whose driver’s license has been suspended for a refusal to submit to a chemical test may qualify. People who are revoked must also comply with any and all testing required to be relicensed.

In order to meet the basic qualifications a person must:

  1. Have served at least 45 days for the suspension or revocation,
  2. File and maintain proof of financial responsibility (insurance) as required by law for the period of the restricted license, and
  3. Not be suspended or revoked for any other reasons in this or any other state.

Drivers that qualify must have an ignition interlock device installed, at their expense, by a certified installer on all motor vehicles they drive.

The driver must produce written verification that the ignition interlock device has been installed, and verified by the department.

After a driver is issued an ignition interlock Restricted license, they may only drive a vehicle that is equipped with an ignition interlock device; and they are subject to severe criminal penalties for not using the device or attempting to circumvent the device. An ignition interlock restricted license must be held for at least one year.
