Special Announcement

The U.S. Department of Transportation (DOT) has implemented an interim final rule, effective October 3, 2025, that immediately changes how Disadvantaged Business Enterprise (DBE) and Airport Concessions DBE (ACDBE) certifications are assessed.

Key Changes:

  • All DBE and ACDBE firms are now effectively decertified.
  • Race and gender no longer automatically qualify as proof of disadvantage.
  • To maintain program participation, all certified owners must submit a Personal Narrative and a current Personal Net Worth statement.
  • The Personal Narrative should detail personal barriers faced (e.g., limited access to financing or business opportunities) and their resulting financial impact.
  • The definitions of race-conscious and race-neutral measures are removed.
  • Existing certified DBE/ACDBE firms will be reevaluated under this new rule upon submission of the required documentation.
  • Goal setting and other program elements are suspended until reevaluations are finalized.
  • WYDOT DBE Program will provide instructions for securely submitting the necessary documents.

 

Additionally, as the WYDOT Office of Civil Rights is the Unified Certification Program (UCP) for Wyoming, the Interim Final Rule (IFR) provides that we complete the reevaluation process outlined above, each recipient may not: (1) include Disadvantaged Business Enterprise (DBE) contract goals or concession-specific Airport Concession Disadvantaged Business Enterprise (ACDBE) goals; or (2) count any participation toward overall DBE or ACDBE goals.


FAA DBE Goal

In accordance with requirements of the U.S. Department of Transportation, as set forth in 49 C.F.R. Part 26, as amended, the Wyoming Department of Transportation Disadvantaged Business Enterprise (DBE) goal for the applicable professional services and procurement contracts will begin on October 1, 2023, and end on September 30, 2026. 

WYDOT's Disadvantaged Business Enterprise Federal Aviation Administration Annual Participation Goal through August 30, 2023, will be 3.7% utilizing an all-race and gender-neutral program.

FHWA DBE Goal

In accordance with requirements of the U.S. Department of Transportation, as set forth in 49 C.F.R. Part 26, as amended, the Wyoming Department of Transportation Disadvantaged Business Enterprise goal for the applicable construction, professional services, and procurement contracts will begin on October 1, 2024, and end on September 30, 2027. 

WYDOT’s Disadvantaged Business Enterprise Federal Transit Administration Annual Participation Goal through September 30, 2026 will be 5.3% utilizing an all race and gender-neutral program.

FTA DBE Goal

In accordance with requirements of the U.S. Department of Transportation as set forth in 49 C.F.R. Part 26, as amended, the Wyoming Department of Transportation Disadvantaged Business Enterprise goal for the applicable construction, professional services and procurement contracts will begin on October 1, 2023 and end on September 30, 2026. 

WYDOT’s Disadvantaged Business Enterprise Federal Transit Administration Annual Participation Goal through September 30, 2026, will be 2.0% utilizing an all-race and gender-neutral program.
